This End User License Agreement is a binding legal agreement between you and PremiumWP.com. Purchase, installation or use of a theme from PremiumWP signifies that you have read, understood and agree to the terms and conditions listed below.
1. WordPress
WordPress is a state-of-the-art publishing platform with a focus on aesthetics, web standards, and usability. Before using a theme sold by PremiumWP.com, you must first have a fresh install of WordPress running on your web server. If you do not know what WordPress is, or how to install it, go to WordPress.org and read the Getting Started With WordPress documentation prior to purchasing a theme.
2. Use of Themes
With the purchase of a theme from PremiumWP.com, you are able to utilise the theme for personal use as well as client work without any limit to the number of times the themes can be used.
3. Payment & Delivery
The template files are available for instant download as soon as we receive your payment. This may take up to 1 hour but usually happens within minutes. Payment and file downloading is handled by E-junkie. If you do not receive an email after this time period contact payments@premiumwp.com
4. Modifications
You are authorized to make any necessary modification(s) to the themes to fit your purposes. PremiumWP themes were created for development – this means that images, colors, fonts, layouts and anything else related to the design of the themes can be changed or modified.
5. Refund policy
Since PremiumWP is offering non-tangible irrevocable, digital goods which are delivered via digital download we do not issue refunds after a purchase has been made from our site. All sales are final. The themes sold on PremiumWP have a fully functional “live” demo running the latest stable version of WordPress which can be tested at will. You are advised to fully test the theme before purchase to ensure it meets your requirements.
6. Theme Support
PremiumWP customers will receive read and write access to our support forums. Before providing access to the Theme Support Forum to any user, proof of theme ownership must be verified. Please register at the support forum then send an email to “payments@premiumwp.com” with your forum username, email address, as well as the Google or PayPal transaction ID for your purchase.
It is our policy that we will only provide assistance with technical queries in the support forum. All support documentation (including tutorials) will also be available to customers in the support forum. This is the quickest and most efficient way for anyone who has purchased a theme package to receive support. The support that we offer shall include common issues and bugs that might occur, and not necessarily customization of any themes.
PremiumWP offer these templates and designs ‘as is’, with no implied meaning that they will function exactly as you wish or with all 3rd party components and plugins. Further, we offer no support via email or otherwise for installation, customization, administration of WordPress itself.
7. Theme Updates
Themes are updated as required and designed to be compatible with the latest stable version of WordPress (currently 2.8) downloaded from WordPress.org, but we can give no guarantee that older versions of themes will run with future versions of WordPress. Updates and new versions for any theme purchased are distributed free of charge for any current theme owner. Please note that PremiumWP themes are not compatible with WPMU at this time.
8. Price Changes
PremiumWP reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, a theme with or without notice. Prices of all products are subject to changes without notice.
9. Theme License
All themes sold by PremiumWP are released under the GNU general public license (http://www.gnu.org/licenses/gpl.html). Upon purchase, you are authorized to make any necessary modifications to products to fit your purposes. Also, you may use purchased themes on as many websites as you like for personal, business or client projects.
10. Warranty
PremiumWP does not warranty or guarantee these templates in any manner. Themes sold by PremiumWP will run on the latest stable version of WordPress (currently 2.8) under a “clean” installation. We do not guarantee that any PremiumWP themes will run properly on anything less than WordPress 2.8. Please note that these themes are not compatible with WPMU at this time. Once you modify any theme files or install third party plugins, We cannot guarantee that the theme will work, nor are we responsible to support any problems that occur as a result of modified themes. We cannot guarantee they will function with all 3rd party components, plugins or web browsers. Browser compatibility should be tested against the demonstration templates on the demo server. Please ensure that the browsers you use will work with the templates as we cannot guarantee that PremiumWP templates will work with all browser combinations.
